This isn't the Feds either, it is the States that set the water laws.

There's an *enormous* volume of federal law regulating water distribution, especially in the West. This is a great summary by the CBO that I came across while researching who the hell I had to talk to in order to exceed my allocation and, you know, operate a brewery.

The Feds got involved when CA and AZ went to war. (Almost) over the Colorado water.  There are the Fed laws on top of the state and water district laws.  You are correct.

In the West water does not flow downhill.  It flows towards money.

Damn. I never really thought of it that way. I'm gonna have to look at my deed or whatnot. I can't remember about the mineral right. Probably not though.

And I have to look into the water from the sky issue. I had to install a sub-pump in my backyard to pump out the many thousands of gallons that collects there when it rains real hard. The effluent goes across my front yard and into the street. I want to get a couple 1000 gallon tanks to pump the water into to at least save and use some of it to water my vegetable garden and plants.

I know we don't own our mineral rights, not that it's likely they'll find anything here.

Interesting about the water collecting in your hard euge - can you call the state and tell them to come get their stuff off your property? ;D

To me, Water is Politics.  I have secured adjudicated water rights to the 2 wells on my property.

Colorado exempts households and home use, which I think is great, and encourages wise and sustainable use at a homestead scale.
I did not know that.  That's good.
The other side is that we can't pipe it to the street either.  I guess they want it to go straight into my basement.

Lovin' life near good ol' Lake Erie - plenty of fresh water here.  The latest in our region concerning property rights has to do with mineral (oil & gas) rights related to hydro-fracturing of shale formations.

And it's been years since the lake caught on fire too. 
Drinking water will be the next big war on a global scale, and it's been going on inside the US for decades.

i grew up on lake erie. miss it horribly.

just wondering. we are supposed to get blasted with snow tonight. am i allowed to shovel my walk and driveway?, how about my sump pump when it rains.
